Effective 2024-09-27US raises Section 301 tariffs on Chinese EVs, batteries, and solar
USTR finalised increased Section 301 tariffs targeting strategic sectors. EV duty rises to 100%, lithium-ion EV batteries to 25%, photovoltaic cells to 50%, semiconductors to 50% by 2025.
On 13 September 2024, USTR finalised modifications to Section 301 actions against China:
- New energy vehicles (EVs): tariff raised to 100% (HS 8703.80)
- Lithium-ion EV batteries (HS 8507.60): 25%
- Lithium-ion non-EV batteries: 25% from 2026
- Photovoltaic cells and modules (HS 8541.43): 50%
- Semiconductors (HS 8542.xx): 50% from 2025
- Steel and aluminium derivative products: 25%
- Ship-to-shore cranes: 25%
The increases stack on top of MFN duty and pre-existing List 1-4 Section 301 rates. EU and other partners are not affected. Companies should review supply chain origin and consider FTZ, drawback, or first-sale-for-export strategies.
